Partner Program Terms & Conditions

These Partner Program Terms & Conditions (“Terms”) govern participation in the Beyond Six Partner Program (“Program”), operated by Growing Brands Lda, trading as Beyond Six, a company incorporated in Portugal (“Beyond Six”, “we”, “us”, or “our”).

By applying to or participating in the Program, you (“Partner”, “you”) agree to be bound by these Terms.

1. Eligibility & Approval

1.1 The Program is open to individuals and businesses, including agencies and consultants.

1.2 All Partner applications are manually reviewed and approved by Beyond Six. Submission of an application does not guarantee acceptance.

1.3 To be eligible, Partners must meet the following minimum requirements:

  • Have an existing e-commerce client base

  • Operate in a relevant professional field, such as (but not limited to): design, CRO, email marketing, Meta Ads management, or related marketing services

1.4 Beyond Six reserves the right to approve or reject any application at its sole discretion.

2. Definition of a Valid Referral

2.1 A valid referral is defined as:

  • A lead submitted through the official Partner Program referral page, and

  • Subsequently accepted by Beyond Six.

2.2 To qualify as a commission-eligible referral, the referred client must:

  • Sign a services agreement with Beyond Six, and

  • Pay the first invoice in full, which is charged upfront.

2.3 A referral may be rejected if:

  • The client already exists in Beyond Six’s CRM

  • The client previously contacted Beyond Six directly

  • The client was referred by another Partner

  • The client is not an e-commerce business

  • The client is not spending at least $10,000 per month on Google Ads

2.4 Beyond Six’s determination regarding referral eligibility is final.

3. Commission Structure

3.1 Approved Partners are entitled to:

  • 100% of the first month’s management fee, and

  • 20% recurring commission, lifetime.

3.2 “Lifetime” means for as long as the referred client remains active and paying Beyond Six.

3.3 Commissions are calculated only on management fees, excluding:

  • Advertising spend

  • Setup fees

  • Taxes (including VAT)

  • Any other ancillary fees

4. Payments

4.1 The first commission is paid after Beyond Six receives payment from the referred client.

4.2 Recurring commissions are paid monthly, on a Net 30 basis.

4.3 There is no minimum payout threshold. Partners are paid monthly for as long as the referred client remains active.

4.4 Payments are made via Wise, in the currency used for client billing (USD or EUR).

5. Fraud, Self-Referrals & Prohibited Conduct

5.1 Self-referrals are strictly prohibited.

5.2 Partners may not:

  • Bid on Beyond Six brand terms or variations

  • Impersonate Beyond Six in any capacity

  • Offer discounts, incentives, or representations on behalf of Beyond Six

5.3 Any suspected fraud, abuse, or misrepresentation constitutes a material breach of these Terms.

5.4 In the event of fraud or breach:

  • The Partner will be immediately terminated

  • Any unpaid commissions will be withheld

  • Beyond Six shall have no further obligations, including commission payments

6. Data Protection & Referrals

6.1 Partners submit only:

  • Brand name

  • Website URL

6.2 If a referral is accepted, the Partner must make a warm introduction via email to connect Beyond Six with the prospective client.

6.3 Partners confirm that any information shared is done in accordance with applicable data protection laws and does not infringe third-party rights.

7. Termination & Program Changes

7.1 The Program relationship continues unless terminated due to breach of these Terms.

7.2 Upon termination:

  • All commission payments cease immediately

  • No commissions are owed for existing or future clients

7.3 Beyond Six may modify commission rates or Program terms for future referrals only. Existing approved referrals remain subject to the terms in place at the time of referral.

8. Brand Usage & Representation

8.1 Partners may not use Beyond Six logos, trademarks, or branding assets.

8.2 Partners may state that they “partner with Beyond Six” but may not:

  • Use Beyond Six’s name in marketing materials

  • Publish copy or promotional content referencing Beyond Six

  • Represent themselves as agents or representatives of Beyond Six

8.3 Beyond Six reserves the right to request removal of any content that misrepresents the relationship.

9. Governing Law & Dispute Resolution

9.1 These Terms are governed by the laws of Portugal.

9.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lisbon, Portugal.

10. Acceptance

By submitting a Partner application or participating in the Program, you confirm that you have read, understood, and agreed to these Terms.
